Transcription of the Testament of Dugald MacFarlane of Aucharossan


 

The   Testament   Dative

 

and   Inventary   of   the   debts   and  sums of  money  which   belonged  and were addebted resting  and owing to the deceased  Dugald MacFarlane of Aucharossan  at  the  time  of  his  decease  which  was  in  the month of .....One thousand  seven hundred and  .....  Faithfully  made  and  given  up  by  Andrew MacFarlane son and Executor dative qua nearest  in  him   decerned   to  the  said  defiant  Conform to decreed dative of the  Commissary  substitute  of  Argyll  bearing  date the  ninth day of December One thousand seven  hundred and eighty five years

Inventary

          There   was   justly   addebtes   resting   and   owing   to   the  defunct   at  the  time   of   his   decease   the  sum  of   Two   pounds  twelve   shillings    sterling   being   part   of  a  greater  debt  due  to  the   said    defunct   by   the    deceased    George    MacFarlane  sometime    drover   in    Ardvorlich    thereafter   in   Lorne  and  for    which    sum    the   said     defuncts     Representatives    were  ranked in a  process of multiple poinding at the instance of Cornelius Elliot writer to the signet Against the said George MacFarlanes  Representatives and creditors conform to Interlocular of the lord ordinary dated the twenty eight day of February One thousand seven  hundred and eighty three years.

 Confirmation

            I   Lachlan Campbell  Commissary  substitute of  the  Commissariat   of   Argyll   understanding   that  after   due  summoning  and  lawfull  warning  made  by  public  form of Edict  openly as officers of the Executors testamentors spouse Bairns if any be  and intramitters with the goods  and  give  of  the said  unquhil  Dugald  MacFarlane  and  all  others  having  or   pretending   to  have  interest  in  the  said  matter  to  have  compeared  before  the  Commissary  of  the  said Commissariat  his  depute  or  substitute  judicially  on a  certain  day  now  bygone  to  have  answered  at  the  instance  of  the  said Andrew  MacFarlane  to  have heard and seen  circulars dative  qua  nearest  in him deceived  given in admitted  and  confirmed  to the  said defunct and in and to all and  sundry  goods  gear  Corns  Cattle  gold  silver  coins  and  uncoined  debts  sums  of money  and others whatsoever  which   portained   and  were   addebled   to the   said   defunct  at the  time  of  his  decease  or  else  to  have  alledged  a  reasonable  cause in  the  contrary with Certification  as  esserted I  decerned  there until  as   my   decree   dative   at  the  date   abovewritten   bears  Conform  where ante  Fin  our  sovereign   Lords  name  and  authority  and  mine  make  constitute  ordain and  confirm  the said  Andrew  MacFarlane  in  only  executor  dative  qua  nearest  of  him  to  the  said  deceased  Dugald  MacFarlane  his  father  and  in  and  to the debts  and  sums  of  money  contained  in  the  foregoing  Inventary With  power  to  him  to  ask  crave   intramitt   with  and  uplift  the  same And  generally  every  other  thing  there  anent  to  do  use  and  excrue   which    to    the    office    of    Executor   in   the   like  cases   by   the   law   and   custom of   Scotland  is   sovereign  to  appertain   Providing   always   that   the   said   Andrew   MacFarlane   under    just    compt   reckoning    and    payment   of  his intromissions    therein   when   and   where   the    same  shall  be  legally  required   Where  upon  and   that  the   debts  contained   in   the   said  Inventary  shall   be  free  and  forthcoming   to   all    parties    having   interest   as   law   will  George  MacFarlane  in  Auchachrossan ----------- has  became  Cautioner  as  a   Bond  of  Caution  given  in   there   anent   bears  In   Testimony   where   of   these  present    are    subscribed    by   me    and   the   Clerk    of  Court   At    Inverary    the    forth    day    of    April  One  thousand   seven   hundred   and   eighty   six   years
